This website is operated by Danita Brooks. Danita Brooks offers this website, including all information, tools, and services available from this Site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. Throughout the Site, the terms “we,” “us,” and “our” refer to Danita Brooks. Please read these Terms and Conditions carefully before accessing or using our website. You agree to be bound by these Terms and Conditions by accessing or using any part of the Site.
Danita Brooks Studio (danitabrooks.com) offers original paintings, commissioned paintings, prints, photography, and other products.
RIGHTS TO ARTWORK AND IMAGES
All photography, artwork, and graphics are the sole property of Danita Brooks and may not be used by any third party without written permission.
Danita Brooks retains all rights to all artwork until it has been purchased by a private or public collector, at which time the collector receives the right to display the artwork in their home or business.
Danita Brooks retains all rights to the image of all artwork including the rights to the image of sold & commissioned original paintings, and the rights to make prints of any of the art I create—unless a collector or client has purchased rights to use the work in a further application.
COLLECTORS OF PRINTS OR DIGITAL COPIES OF ARTWORK OR PHOTOGRAPHS HAVE THE RIGHT TO DISPLAY THE ARTWORK IN THEIR HOME OR BUSINESS, BUT RETAIN NO OTHER RIGHTS TO THE ARTWORK.
Collectors of prints or artwork Danita has produced have the right to display the art in their home or business, but retain no other rights to use the artwork for commercial purposes. All other uses must be agreed to in advance in writing by contacting danita@danitabrooks.com
CANCELLATION AND REFUND POLICY
Prints—You may cancel your order within the first 24 hours. After 24 hours, your order will begin production. Prints are made on-demand, so after 24 hours, there are no refunds or cancellations. Please get in touch with danita@danitabrooks.com if you need help.
Original Paintings—All sales of original artwork are final. Returns or exchanges of original work are not available except for extreme situations. Please contact me at danita@danitabrooks.com.
